These Terms and Conditions (“Terms”) govern your use of the Tank Track mobile application, website, and related services (together, the “Service”) operated by TANK TRACK APP (“Tank Track”, “we”, “us”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. By registering, you confirm that the information you provide is accurate and that you are legally able to enter into this agreement.

Your Account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at support@tanktrack.app if you suspect unauthorized access. We may suspend or terminate accounts that are inactive, that violate these Terms, or that we reasonably believe are being used to defraud or harm others.

License to Use the App

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for your own lawful purposes. You may not copy, reverse engineer, modify, rent, resell, or create derivative works from the App except where the law gives you a right we cannot restrict.

Subscriptions and Payments

Some features require a paid subscription. Pricing, billing cycle, and trial terms are shown at the point of purchase.

• Subscriptions purchased through the Apple App Store or Google Play are billed by Apple or Google and renew automatically unless you cancel through your store account at least 24 hours before the renewal date.
• Subscriptions purchased directly are billed by [Payment Processor Name] and renew automatically until cancelled inside the App or through your account dashboard.
• Refunds follow the policy of the platform you bought through. For direct purchases, refund requests can be sent to billing@tanktrack.app.

Taxes are added where required by law.

Acceptable Use

When using the Service, you agree not to:

• Upload unlawful, defamatory, harassing, or infringing content.
• Attempt to break, probe, or overload our systems.
• Use the Service to send spam or unsolicited messages.
• Impersonate another person or misrepresent your identity.
• Scrape, reproduce, or redistribute Service content without permission.

We may remove content or suspend accounts that violate these rules.

User Content

You keep ownership of content you submit (such as vehicle data, fuel entries, notes, photos, or feedback). By submitting content, you give us a worldwide, royalty-free license to host, store, process, and display it for the purpose of running the Service. You are responsible for making sure you have the right to share whatever you upload.

Third Party Services

The Service may connect to or rely on third party services such as Apple, Google, payment processors, mapping providers, and analytics tools. We are not responsible for the content, accuracy, or practices of those services. Your use of them is governed by their own terms.

Intellectual Property

The App, including its software, design, logos, and trademarks, is owned by Tank Track or its licensers and is protected by intellectual property laws. Nothing in these Terms transfers ownership to you.

Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent allowed by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, accuracy of data, and non-infringement. Fuel readings, mileage, analytics, and reports are estimates based on the data you and your devices provide; they should not be the sole basis for safety, financial, or operational decisions.

Limitation of Liability

To the maximum extent allowed by law, Tank Track and its officers, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 100.

Indemnity

You agree to defend and hold Tank Track harmless from claims, damages, and reasonable legal fees arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third party right.

Termination

You may stop using the Service at any time by deleting your account in the App. We may suspend or terminate your access if you breach these Terms, if continued service would create legal or security risk, or if we discontinue the Service. Sections that by nature should survive termination, including payment obligations, disclaimers, limitation of liability, and dispute resolution, will continue to apply.

Changes to the Service or Terms

We may add, change, or remove features, and we may update these Terms. If we make a material change, we will notify you inside the App or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.

Governing Law and Disputes

These Terms are governed by the laws of [Governing Jurisdiction], without regard to conflict of law rules. Any dispute will be brought in the courts of [Governing Jurisdiction], unless your local consumer law requires otherwise. Nothing here removes any non-waivable rights you have as a consumer.

Apple and Google Store Provisions

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Tank Track only, not Apple, and Apple has no obligation to provide support for the App. Apple is a third party beneficiary entitled to enforce these Terms against you. Similar provisions apply to Google Play.
